Tragic School Crossing Accident In San Marcos, San Diego

"A heartbreaking morning for San Diego's San Carlos community. Three siblings were crossing the street near their school when they were hit by a passing vehicle. One of the children, identified as 12-year-old Andrew Joseph Olsen, later died at Rady Children’s Hospital. Officers noted the intersection lacks a marked crosswalk, something neighbors say has been a safety concern for years.

From a legal standpoint, even though the driver wasn’t intoxicated and stayed on the scene, civil liability could still come into play. Drivers must yield to pedestrians in both marked and unmarked crosswalks.

There’s also a potential claim against the City of San Diego if this intersection is found to be a dangerous condition of public property, especially if residents had complained about the lack of crosswalks beforehand.

Families in these situations may file wrongful death or personal injury claims. However, when government property is involved, a formal claim must be filed within six months.
