“So you have a spousal support order and your ex is not paying you the full amount of spousal support that’s been ordered, what should you do?
Well I’m a lawyer so to me it’s quite simple. Step one: Pay up. You’ve been ordered to pay, pay.
Step two: You don’t pay, take them to court. What does that mean? You have to find a legal remedy. What’s the remedy? An enforcement. I could file a request for a contempt. You violated the law; I want to get you put in jail. I could ask the court to sanction you. I could ask the court to impose interest. I could do a variety of the above.
The point is, if there’s a court order you’re probably counting on your support to pay your bills. There’s no reason for it to be late. There’s no reason for it to be underpaid because guess what, when the court made that order, they already made factual findings that that amount could be paid by that person so there is no excuse. So get a lawyer and fight back.”
