Can you legally date someone before your divorce is finalized?
Many people assume they must wait until the divorce is officially over—but that's not always the case. In this video, a California family law attorney explains the legal realities of dating during divorce, the difference between dating and remarriage, and the practical mistakes that can create unnecessary conflict.
While dating after separation is generally legal in California, introducing a new partner to your children too soon or involving them in ongoing divorce proceedings can complicate family dynamics and increase emotional stress.
In this video, you'll learn:

-Can dating affect your divorce or custody case?
-When should children meet a new partner?
-Mistakes to avoid while dating during separation
-Family law advice for navigating new relationships
Whether you're going through a divorce, considering separation, or starting a new relationship, understanding the legal and emotional implications can help you make better decisions for yourself and your family.
"Sometimes I get asked a question by my clients, "Can I date before my divorce is final?"
More often than not, nobody asked me that question. They just start dating.
The right answer here is that once you're separated, you're free to date. And even if you're married and you're dating other people, which is quite common in Southern California, there's no legal prohibition against that. The prohibition legally is if you get remarried, bigamy, while you're still legally married.
My advice would be you probably should date if that's what you want to do and that may be the reason why your marriage has ended.
But don't parade the new mate in front of your ex.
Don't bring the new mate to court.
And be very careful with the new mate as it relates to your children. They're still going to have strong feelings about what's happening with the divorce. And I don't know, mom, real mom. So, you have to proceed with caution, but otherwise, do what you want."
