California Employment Law Frequently Asked Questions (FAQ)
Can my employer really fire me for no reason in California?
They can fire you without giving a reason—but not for an illegal reason. Discrimination, retaliation, and violations of public policy are always unlawful, even in at-will employment. How do I know if my termination was illegal?
Red flags include:
- Being fired shortly after complaining or taking leave
- Sudden negative reviews after years of good performance
- Different treatment than coworkers
- Vague or shifting reasons for termination

What if my employer says it was “just business reasons”?
Employers often give neutral explanations. What matters is whether the stated reason is true or a coverfor discrimination or retaliation.
Courts look at timing and patterns, not just what the employer says.
Do I need a contract to sue for wrongful termination?
No. Many wrongful termination claims in California exist withouta written contract. At-will employees are still protected by state and federal law.
What if I quit instead of being fired?
If you were forced to quit because your employer made working conditions unbearable, you may still have a claim for constructive termination.
What evidence should I keep if I think my termination was wrongful?
Save:
- Emails and text messages
- Performance reviews
- HR complaints
- Medical or leave requests
- Write-ups or warnings

Should I talk to a lawyer before signing a severance agreement?
ALWAYS!!!! Severance agreements often require you to give up legal rights. An employment attorney can help you understand what you’re being asked to waive—and whether you should negotiate.
How long do I have to take legal action?
Deadlines vary depending on the claim. Some are short. Waiting too long can hurt your case, so it’s best to speak with an attorney sooner rather than later.
